"Vicious dog" means:
a.Any dog which has attacked a human being or domestic animal one or more times, without provocation; or
b.Any dog with a history, tendency or disposition to attack, to cause injury or to otherwise endanger the safety of human beings or domestic animals; or
c.Any dog that snaps, bites or manifests a disposition to snap or bite; or
d.Any dog that has been trained for dog fighting, animal fighting or animal baiting, or is owned or kept for such purposes; or
e.Any dog trained to attack human beings upon command or spontaneously in response to human activities except dogs owned by and under the control of the police department, a law enforcement agency of the state or the United States or a branch of the armed forces of the United States; or
f.Staffordshire terrier breed of dog; or
g.The American pit bull terrier breed of dog; or
h.The American Staffordshire terrier breed of dog; or
i.Dogs of mixed breed or of other breeds than above listed which breed or mixed breed is known as pit bulls, pit bull dogs or pit bull terriers; or
j.Any dog which has the appearance and characteristics of being predominately of the breeds of Staffordshire terrier, American pit bull terrier, American Staffordshire terrier; any other breed commonly known as pit bulls, pit bull dogs or pit bull terriers, or a combination of any of these breeds.

VICIOUS DOGS. It is unlawful for any person to harbor or keep a vicious dog within the City. If proper documentation is not available and the breed is in question, then the owner of dog must have the dog submit to blood testing with cost to the owner, to determine the breed. “Vicious dog” means:
Section 7.6
Keeping of Dangerous Animals. No person shall keep or permit to be kept any dangerous animal as a pet or for display or for exhibition purposes, whether gratuitously or for a fee.
Section 9.4.32
Dangerous Animals. Defined as the following:
32. The American Pit Bull Terrier, American Staffordshire Terrier, and/or
Staffordshire Bull breeds of Canis familiaris;
1. “Dangerous animal” means: (i) any animal which is not naturally tame or gentle, and which is of a wild nature or disposition, and which is capable of killing, inflicting serious injury upon or causing disease among human beings or domestic animals and having known tendencies as a species to do so; (ii) any animal declared to be dangerous by the Council; and (iii) the following animals, which are deemed to be dangerous animals per se:
F. Pit bull terriers, Staffordshire Terriers, American Pit Bull Terriers, American Staffordshire Terriers, or any dog which has the appearance and characteristics of being predominately of said breeds
57.02 Definitions
“Dangerous animal” means: (i) any animal that is not naturally tame or gentle, and which is of a wild nature or disposition, and which is capable of killing, inflicting serious injury upon, or causing disease among, human beings or domestic animals and having known tendencies as a species to do so (ii) any animals declared to be dangerous by the County Board of Health; (iii) any animal which has bitten or clawed a person on two or more occasions; (iv) the following animals, which are deemed to be dangerous per se:
A. Lions, tigers, jaguars, leopards, cougars, lynx and bobcats.
B. Wolves, coyotes and foxes.
C. Badgers, wolverines, weasels, skunk and mink.
D. Raccoons.
E. Bears.
F. Monkey and chimpanzees.
G. Bats.
H. Alligators and crocodiles.
I. Scorpions.
J. Snakes that are venomous or constrictors.
K. Gila monsters.
L. Pit bull terriers.
57.03 KEEPING OF DANGEROUS ANIMALS PROHIBITED. No person shall keep, shelter or harbor any dangerous animal as a pet, or act as a temporary custodian for such an animal, or keep, shelter, or harbor such animal for any other purpose or in any other capacity within the City except that this section does not apply to the keeping of dangerous animals under the following circumstances:
DANGEROUS ANIMALS PROHIBITED.
1. No person shall keep, shelter, or harbor for any purpose within the City limits, a dangerous animal.
2. Definitions. A dangerous animal is:
a. Any animal which is not naturally tame or gentle, and which is of a wild nature or disposition, and which is capable of killing, inflicting serious injury upon, or causing disease among human beings or domestic animals, and having known tendencies as a species to do so.
b. The following are animals which shall be deemed to be dangerous animals per se:
(1) Lions, tigers, jaguars, leopards, cougars, lynx, and bobcats;
(2) Wolves, coyotes, and foxes;
(3) Badgers, wolverines, weasels, skunks and mink;
(4) Raccoons;
(5) Bears;
(6) Monkeys, chimpanzees, and apes;
(7) Alligators and crocodiles;
(8) Scorpions; gila monsters;
(9) Snakes that are venomous or constrictors;
(10) Any pit bull terrier, which is defined as any Staffordshire Bull Terrier breed of
dog or any mixed breed of dog which contains as an element of its breeding the breed of
Staffordshire Terrier as to be identifiable as partially of the breed of Staffordshire Bull Terrier,
American Staffordshire Terrier, American Bully, American Pit Bull Terrier, Blue Nose or Red
Nose Pit Bull by a qualified veterinarian duly licensed as such by the State.
Prohibited Pets
On October 20, 2008, the City Council passed ordinance 1288 which prohibits Rottweiler, Pit Bull, Dogo (or otherwise known as Presa Carario) and vicious animals to be licensed in Centerville. There were a few of these dogs which were grandfathered in to allowed to be licensed. No animal of this nature is allowed to be licensed in the City of Centerville.
55.17 KENNELING REQUIRED. Kenneling is required within the corporate limits of the City with regard to the following animals when they are not under the direct control and supervision of the owner.
1. Pit bull terriers, including the following:
A. The Bull Terrier breed of dog;
B. The Staffordshire Bull Terrier breed;
C. The American Pit Bull Terrier breed;
D. The American Staffordshire Terrier breed;
E. Dogs of mixed breed or of other breeds than above listed which breed or mixed breed is known as pit bulls, pit bull dogs or pit bull terriers; or
F. Any dog which has the appearance and characteristics of being predominately of the breeds of Bull Terrier, Staffordshire Bull Terrier, American Pit Bull Terrier, American Staffordshire Terrier, any other breed commonly known as pit bulls, pit bull dogs or pit bull terriers, or a combination of any of these breeds.
2. Dogs of the breed or “mixed breeds” of Akita, Rottweiller,
Doberman, or Chow.
A “kennel” shall be defined as an enclosed structure with walls at least five feet high, fastened to a concrete base at least 3½" thick, and having a secure top.
4-1-1 Definitions
The term “dangerous domestic animals” shall mean Staffordshire Terriers, known as “Pit
Bulls”, American Pit Bull Terriers and American Staffordshire Terriers.
4-1-7 DANGEROUS DOMESTIC ANIMALS.
Dangerous domestic animals shall be muzzled at all times while outside and located within the City limits of the City of Coggon.
56.02 KEEPING OF DANGEROUS ANIMALS PROHIBITED.
No person shall keep, shelter or harbor for any reason within the City a dangerous animal except the prohibition contained in this section does not apply to the keeping of dangerous animals under the control of a law enforcement or military agency.
55.12 POTENTIALLY DANGEROUS ANIMALS AND DANGEROUS ANIMALS.5. Vicious Dogs. Notwithstanding any other provision of this chapter, no person owning, possessing, harboring or having the care of a vicious dog shall permit such animal within the City except as provided in this section of the Code.

55.09 HIGH RISK DOGS
1. Confinement. All high risk dogs shall be securely confined within an occupied house or residence or in a securely enclosed and locked pen or kennel, except when leashed on property owned or leased by the dog’s owner. Such pen, kennel, or structure must have secure sides and a secure top attached to the sides or in lieu of a top, walls at least six feet in height and at least six inches taller than any internal structure. All pens or other structures designed, constructed or used to confine high risk dogs must be locked with a key or combination lock when such animals are within the structure. Such structure must have a secure bottom, floor or foundation attached to the sides of the pen or the sides of the pen must be embedded in the ground no less than two (2) feet so as to prevent digging under the walls by the confined dog. All structures erected to house high risk dogs must comply with all zoning and building regulations of the City. All such structures must be adequately lighted and ventilated and kept in a clean and sanitary condition. No high risk dog may be kept on a porch, deck, patio or in any porch, deck, or patio of a house or structure that would allow the dog to exit such building on its own volition.
2. Leashing. No person shall permit a high risk dog to go outside its kennel or pen unless such dog is securely leashed with a leash no longer than six (6) feet in length, and further provided that when leashed such dog must be on property owned or leased by its owner. No person shall permit a high risk dog to be kept on a chain, rope, or other type of leash outside its kennel or pen unless both dog and leash are under the actual physical control of a person eighteen years of age or older. Such dogs may not be leashed to inanimate objects such as trees, posts, buildings, or any other object or structure.
3. At Large. A high risk dog which is found, more than twice in any calendar year, not to be confined as herein required, shall be required to be permanently removed from the City or destroyed. An animal which is returned to the City after removal shall be humanely destroyed.
4. Limit on Number. No residential dwelling shall have more than one high risk dog on its premises.
Sec. 18-44.01. - Insurance on high risk dogs not licensed.
The owner of every dog which is defined as high risk under section 18-41 of this article, or which is both high risk and under six months of age, or is high risk and not licensed shall maintain insurance as set forth in section 18-44(f) of this article.
55.12 PROHIBITED ANIMALS
No person is permitted to keep within the City any of the following animals, whether actually vicious or not: Lions, tigers, jaguars, leopards, cougars, lynx, ocelots, bobcats, bears, wolves, coyotes, pit bull dogs (or cross breeds where one parent is a wolf, coyote, or pit bull), crocodiles, alligators, and all venomous or constricting snakes.
56.01 DEFINITIONS.
For use in this chapter, the following terms are defined:
1. “Dangerous animal” means the following animals:
A. The bull terrier breed of dog;
B. The Staffordshire bull terrier breed;
C. The American Staffordshire terrier breed;
D. The American pit bullterrier breed;
E. Dogs of mixed breed or other breeds which are known as pit bulls, pit bulldogs or pit bull terriers;
56.02 KEEPING OF DANGEROUS ANIMALS PROHIBITED.
No person shall keep, shelter, or harbor any dangerous animal as a pet, or act as a temporary custodian for such animal, or keep, shelter or harbor such animal for any purpose or in any capacity within the City.
55.14 KEEPING OF DANGEROUS DOGS.
1. The provisions of this section apply to adult dogs only, which means any dog over the age of six months.
2. A dangerous dog is at large if such dog is not securely confined indoors or confined in a securely enclosed and locked pen or structure upon the premises of the owner of such dog. Such pen or structure must have secure sides and a secure top. If the pen or structure has no bottom secured to the sides, the sides must be embedded into the ground no less than one foot.
3. No person owning or harboring or having the care of a dangerous dog shall suffer or permit such animal to go unconfined on the premises of such person.
4. No person owning or harboring or having the care of a dangerous dog shall suffer or permit such dog to go beyond the premises of such person unless such dog is securely leashed and muzzled, except that a dangerous dog shall not be required to be muzzled when shown in a sanctioned Kennel Club Show.
54.06 Pit Bulls Prohibited
Except as otherwise provided in this section, it shall be unlawful for any person to own, possess, keep, exercise control over, maintain, harbor, transport, or sell any pit bull within the City of Glenwood, Iowa.
55.01 DEFINITIONS.
The following terms are defined for use in this chapter.
G. The American Pit Bull Terrier breed of dogs;
55.18 VICIOUS DOG PERMITS It is unlawful for any person to harbor or keep a vicious dog within the City without first obtaining a vicious dog permit in accordance with the following:
1. Application. The application for a vicious dog permit must
include the following:
A. Certificate of Insurance issued by an insurance company licensed to do business in the State, providing personal liability
insurance coverage as in a homeowner’s policy, with a minimum liability amount of $100,000 for the injury or death of any person,
for damage to property of others and for acts of negligence by the owner or agent in the keeping or owning of such vicious dog.
Said certificate shall require notice to the City, in conformity with general City standards for certificates of insurance, in the event of
underlying policy of insurance is canceled for any reason.
B. The cancellation or other termination of any insurance policy, presented to comply with this section, shall automatically
revoke and terminate the permits issued under this section unless another certificate, complying with this section, shall be provided
showing insurance in effect at the time of such cancellation or termination.
2. Photos. The application must be presented to the Police Chief with two color photos of the dog.
3. Notification of Changes. The owner of the vicious dog shall be required to notify the City within 24 hours of any transfer of ownership of the dog, the dog’s escape or death, any change of address by the owner, or birth of offspring to the dog.
56.01 DEFINITIONS.
2. “Dangerous animal” means:
H. Pit Bull Dogs. “Pit bull” is defined as any dog that is an American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier or any dog which has the appearance and characteristics of being predominately of one or more of the foregoing breeds as measured against the standards established by the American Kennel Club or United Kennel Club for any of the foregoing breeds.
56.02 KEEPING OF DANGEROUS ANIMALS PROHIBITED.
No person shall keep, shelter or harbor for any reason in the City any dangerous animal except as provided in Subsection 56.03(1).
55.01 DEFINITIONS.
The following terms are defined for use in this chapter:
C. The following animals, which shall be deemed to be dangerous per se: Lions, tigers, jaguars, leopards, cougars, lynx
and bobcats; wolves, coyotes and foxes; badgers, wolverines, weasels, skunks and mink, raccoons; bears; monkeys and
chimpanzees; bats; alligators and crocodiles; scorpions; snakes that are venomous or constrictors; gila monsters; pit bull dogs.
55.17 KEEPING OF VICIOUS OR DANGEROUS ANIMALS PROHIBITED.
It shall be unlawful for any person to harbor, keep, or shelter any dangerous or vicious animal as a pet, or act as a temporary custodian for
such animal, or keep, shelter, or harbor such animal for any other purpose or in any other capacity within the City exempt as provided in this section:
4-1-6 DANGEROUS ANIMALS.
1. Dangerous Animals Prohibited. No person shall keep, shelter, or harbor for any
purpose within the City limits, a dangerous animal.
b. The following are animals which shall be deemed to be dangerous animals per se:
(1) Lions, tigers, jaguars, leopards, cougars, lynx, and bobcats;
(2) Wolves, coyotes, and foxes;
(3) Badgers, wolverines, weasels, skunks and mink;
(4) Raccoons;
(5) Bears;
(6) Monkeys, chimpanzees, and apes;
(7) Alligators and crocodiles;
(8) Scorpions; gila monsters;
(9) Snakes that are venomous or constrictors;
(10) Staffordshire terriers - known as pit bulls;
(11) Pit bulls meaning any dog that is an American Pit Bull Terrier, American
Staffordshire Terrier, Staffordshire Bull Terrier, or any dog displaying the majority of physical
traits of any one or more of the above breeds (more so than any other breed), or any dog
exhibiting those distinguishing characteristics which substantially conform to the standards
established by the American Kennel Club or United Kennel Club for any of the above breeds.
4-1-7B PIT BULL TERRIERS PROHIBITED.
1. As used in this section, the term “pit bull terrier” shall be defined as follows:
a. Staffordshire Terrier breed of dog; or
b. The American pit bull terrier breed of dog; or
c. The American Staffordshire terrier breed of dog; or
d. Any dog which has the appearance and characteristics of being predominately of the breeds of Staffordshire terrier, American pit bull terrier, or American Staffordshire terrier.
2. It shall be unlawful for any person, from and after six (6) months following the passage and publication of this ordinance, to keep, maintain, or have in his or her possession or under his or her control, within the city limits of the City of Maquoketa, Iowa, a pit bull terrier, as defined in this section.
56.01 DEFINITIONS.
For use in this chapter, the following terms are defined:
1. “Dangerous animal” means the following animals:
G. Pit bull terriers, including the following:
(1) The bull terrier breed of dog.
(2) The Staffordshire bull terrier breed.
(3) The American Staffordshire terrier breed.
(4) The American pit bull terrier breed.
(5) Dogs of mixed breed or other breeds which are known as pit bulls, pit bulldogs or pit bull terriers.
(6) Any dog which has the appearance and characteristics of being predominantly of the breeds of bull terrier, Staffordshire bull terrier, American pit bull terrier, American Staffordshire terrier, any other breed commonly known as pit bulls, pit bull dogs or pit bull terriers or a combination of any of these breeds.
56.02 KEEPING OF DANGEROUS ANIMALS PROHIBITED.
No person shall keep, shelter, or harbor any dangerous animal as a pet, or act as a temporary custodian for such animal, or keep, shelter or harbor such animal for any purpose or in any capacity within the City.
57.01 DEFINITIONS.
For use in this chapter, the following terms are defined:
E. Pit Bull Terriers, including the following:
(1) The Bull Terrier breed of dog;
(2) The Staffordshire Bull Terrier breed;
(3) The American Staffordshire Terrier breed;
(4) The American Pit Bull Terrier breed;
(5) Dogs of mixed breed or other breeds which are known as pit bulls, pit bulldogs or pit bull terriers;
(6) Any dog which has the appearance and characteristics of being predominantly of the breeds of Bull Terrier, Staffordshire Bull Terrier, American Pit Bull Terrier, American Staffordshire Terrier, any other breed commonly known as pit bulls, pit bull dogs or pit bull terriers or a combination of any of these breeds.
57.02 KEEPING OF DANGEROUS ANIMALS PROHIBITED.
No person shall keep, shelter or harbor any dangerous animal as a pet, or act as a temporary custodian for such animal, or keep, shelter or harbor such animal for any purpose or in any capacity within the City.
56.01 DEFINITIONS
For use in this chapter, the following terms are defined:
3. “Vicious dog” means:
A. Any dog with a known propensity, tendency or disposition to attack unprovoked as evidenced by its habitual or repeated chasing, snapping or barking at human beings or domestic animals so as to potentially cause injury to or otherwise endanger their safety; or
B. Any dog of that breed known variously as American Pit Bull Terrier, American Staffordshire Terrier or Pit Bull Terrier; or
C. Any dog of mixed breed which contains a strain of such breed which is identifiable as such by a qualified veterinarian duly licensed in the State.
56.02 VICIOUS DOGS
Notwithstanding any other provision of this chapter or of Chapter 55, no person owning, possessing, harboring or having the care of a vicious dog shall permit such animal to go unconfined upon the premises of such person or permit the dog to go beyond the premises unless the dog is securely leashed and muzzled. A vicious dog is “unconfined” unless such dog is:
1. Securely confined in a dwelling house.
2. Completely enclosed in a locked, enclosed fence, pen or other structure having a height of at least six feet. Such pen or structure must have secure sides which are imbedded into the ground, if the bottom of the structure is not integrally connected to the structure. If the fence, pen or structure is less than six feet in height, it must have a secure top in addition to securely imbedded sides.
A vicious dog shall not be required to be muzzled when shown in an American Kennel Club show or a show sanctioned by the American Kennel Club or when securely confined in a private vehicle and inaccessible to persons other than those within the vehicle.
ARTICLE IV. - DANGEROUS ANIMALS
Sec. 7-113 - Defined
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Dangerous animal means one who meets one or more of the following conditions:
l.Pit bull terrier
m.Any crossbreed of such animals which have similar characteristics to the animals specified above.
Sec. 7-114. - Keeping prohibited
No person shall keep, shelter, or harbor for any purpose within the city a dangerous animal except as provided in sections 7-115 and 7-116. A violation of this section is a simple misdemeanor resulting in a minimum fine of $100.00.
5-4-2: DEFINITIONS:
Unless otherwise expressly stated or the context clearly indicates a different intention, the following terms shall, for the purpose of this chapter, have the meanings set forth in this section:
DANGEROUS ANIMAL: A. Any animal which is not naturally tame or gentle, and which is of a wild nature or disposition, and which is capable of killing, inflicting serious injury upon, or causing disease among, human beings or domestic animals and having known tendencies as a species to do so;
13. Pit bull dogs;
14. Venomous spiders and insects;
15. Doberman type dogs;
5-4-3: KEEPING DANGEROUS ANIMAL:
No person shall keep, shelter, or harbor any dangerous animal as a pet, nor act as a temporary custodian for such animal, nor keep, shelter, or harbor any such animal for any other purpose or in any other capacity within the city, except as provided in section 5-4-4 of this chapter. provided in this chapter.
55.11 PIT BULL DOGS PROHIBITED.
1. It is unlawful to keep, harbor, own or in any way possess within the corporate limits of the City any pit bull dogs.
2. “Pit bull dog” is defined to mean:
A. The Bull Terrier breed of dog;
B. The Staffordshire Bull Terrier breed of dog;
C. The American Pit Bull Terrier breed of dog;
D. The American Staffordshire Terrier breed of dog;
E. Dogs of mixed breed or of other breeds than above listed which breed or mixed breed is known as pit bulls, pit bull dogs or pit bull terriers; or
F. Any dog which has the appearance and characteristics of being predominately of the breeds of Bull Terrier, Staffordshire Bull Terrier, American Pit Bull Terrier, American Staffordshire Terrier, any other breed commonly known as pit bulls, pit bull dogs or pit bull terriers, or a combination of any of these breeds;
G. Rottweilers or rottweiler breed of dog;
H. Any other breed that has the propensity or has demonstrated
propensity to be a danger to public health and safety.
56.01 DEFINITION OF TERMS
For use in this chapter, the following terms are defined:
1. “Dangerous animal” :
(12) Pit Bulls;
(13) Any crossbreed of such animals which have similar characteristics to the animals specified above.
56.02 KEEPING OF DANGEROUS ANIMALS PROHIBITED
No person shall keep, shelter or harbor any dangerous animal as a pet, or act as a temporary custodian for such animal, or keep, shelter or harbor such animals for any other purpose or in any other capacity within the City except in the following circumstances:

For use in this chapter the following terms are defined as follows:
13. “Vicious animal” means:
f. The Staffordshire Terrier breed of dogs;
g. The American Pit Bull Terrier breed of dogs;
h. The American Staffordshire Terrier breed of dogs;
i. Dogs of mixed breed or of other breeds than above listed, which breed or mixed breed is known as pit bulls, pit bull dogs or pit bull terriers; or
j. Any dog which has the appearance characteristics of being predominately of the breeds of Staffordshire Terrier, American Pit Bull Terrier, American Staffordshire Terrier, any other breed commonly known as pit bulls, pit bull dogs, or pit bull terriers, or a combination of any of these breeds.
4-1-7 UNLAWFUL KEEPING OF ANIMALS
It shall be unlawful for any person or persons to harbor or keep the following types of animals within the City:
1. A vicious or dangerous animal as defined in Section 4-1-1.
It is the duty of the Animal Control Officer to impound any vicious dog or dangerous animal. In the event the animal cannot be caught by the Animal Control Officer without exposing the officer to danger or personal injury, the animal may be destroyed.
57.02 KEEPING PROHIBITED.
It shall be unlawful to keep, harbor, own, or, in any way possess within the corporate limits of the City, any pit bull dog; provided that pit bull dogs registered with the City on the date of publication of this chapter may be kept to the standards and requirements set forth in the provisions of this chapter.
58.10 PIT BULL DOGS PRESUMED DANGEROUS.
There shall be an irrefutable presumption that any dog registered with the City as a pit bull dog is a dangerous dog and is therefore subject to the requirements of this chapter.
56.01 DEFINITIONS
For use in this chapter, the following terms are defined:
“Dangerous animal” means (a) any animal which is not naturally tame or gentle, and which is of a wild nature or disposition, and which is capable of killing, inflicting serious injury upon or causing disease among human beings or domestic animals and having known tendencies as a species to do so; (b) any animal declared to be dangerous by the County Board of Health or Council or its designee; and (c) the following animals, which are deemed to be dangerous animals per se:
2.Any dog which has the appearance and characteristics of being of the breed of Staffordshire Terrier, American Pit Bull Terrier, American Staffordshire Terrier, any other breed commonly known as pit bulls, pit bull dogs or pit bull terriers, or a combination of any of these breeds.
56.02 KEEPING OF DANGEROUS ANIMALS PROHIBITED
No person shall keep, shelter or harbor for any reason within the City a vicious animal except in the following circumstances:
4-1-7 DANGEROUS ANIMALS.
1. Dangerous Animals Prohibited. No person shall keep, shelter, or harbor for any purpose within the City limits, a dangerous animal.
2. Definitions. A dangerous animal is:
a. Any animal which is not naturally tame or gentle, and which is of a wild nature or disposition, and which is capable of killing, inflicting serious injury upon, or causing disease among human beings or domestic animals, and having known tendencies as a species to do so.
b. The following are animals which shall be deemed to be dangerous animals per se:
10. Pit bulls meaning any dog that is an American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier, or any dog displaying the majority of physical traits of any one or more of the above breeds (more so than any other breed), or any dog exhibiting those distinguishing characteristics which substantially conform to the standards established by the American Kennel Club or United Kennel Club for any of the above breeds.
11.Any cross breed of such animals which have similar characteristics of the animals specified above.
57.01 DEFINITION.
For the purposes of this chapter, a “dangerous animal” is defined as:
1. Any animal which is not naturally tame or gentle, and which is of a wild nature or disposition, and which is capable of killing, inflicting serious injury upon, or causing disease among human beings or domestic animals and having known tendencies as a species to do so.
D. Pit bulls, herein defined to be:
(1) The bull terrier breed of dog.
(2) The Staffordshire bull terrier breed.
(3) The American pit bull terrier breed.
(4) The American Staffordshire terrier breed.
(5) Dogs of mixed breed or other breed which are known as pit bulls, pit bull dogs, or pit bull terriers.
(6) Any dog which has the appearance or characteristics of being predominantly of the breeds listed above.
E. Any crossbreeds of such animals which have similar characteristics to the animals specified above.
57.02 KEEPING OF DANGEROUS ANIMALS.
No person shall keep or permit to be kept any dangerous animal as a pet or for display or for exhibition purposes, whether gratuitously or for a fee.
56.06 CERTAIN DOG BREEDS PROHIBITED.
1. Except as provided in Subsections 2 and 3, no person shall keep, shelter or harbor for any reason within the City any dogs of the following breeds:
A. Staffordshire terrier breed of dog; or
B. The American pit bull terrier breed of dog; or
C. The American Staffordshire terrier breed of dog; or
D. Rottweiler breed of dog; or
E. Any dog which has the appearance and characteristics of
being predominately of the breeds of Staffordshire terrier,
American pit bull terrier, American Staffordshire terrier or
Rottweiler.
56.01 DEFINITIONS.
For use in this chapter, the following terms are defined:
C. The following animals, which are deemed to be dangerous animals per se:
(1) Staffordshire bull terrier, bull terrier, American Staffordshire
bull terrier, or American pit bull terrier, more commonly referred to as
a pit bull terrier. An owner may be required to provide evidence, in the
form of a veterinarian’s statement or by DNA, that the animal is not a
member of such breed.
56.02 KEEPING OF DANGEROUS ANIMALS PROHIBITED.
No person shall keep, shelter or harbor any dangerous animal as a pet, or act as a custodian for such animal, temporarily or otherwise, or keep such animal for any other purpose or in any other capacity within the City except in the following circumstances:
55.14 DANGEROUS DOGS
Notwithstanding any other provisions of this chapter, no person owning, possessing, harboring, or having the care of a dangerous dog shall permit such animal to go unconfined upon the premises of such person and shall not permit the dog to go beyond the premises unless the dog is securely leashed and muzzled.
1. For the purpose of this section, a “dangerous dog” (as distinguished from a vicious animal or vicious dog, as defined in Chapter 57 of this Code of Ordinances) means:
A. Any dog which, without provocation, has chased or approached any person in an apparent attitude of attack or menacing fashion such as snarling, growling, snapping, lurching, lunging, or jumping at or upon the person, upon any public or private property other than its owner’s or keeper’s and from which there was no injury to another domestic animal or human; or
B. Any dog of that breed known variously as American pit bull terrier, American Staffordshire terrier, or pit bull terrier; or
C. Any dog of mixed breed which contains a strain of such breeds or which is identifiable as such by a qualified veterinarian duly licensed in the
State.
57.01 DEFINITIONS.
For use in this chapter, the following terms are defined:
1. “Dangerous animal” means: †
A. Badgers, wolverines, weasels, skunk and mink;
B. Raccoons;
C. Bats;
D. Scorpions.
2. “Vicious animal” (as distinguished from a dangerous animal, as defined in Subsection 1 above, and a dangerous dog, as defined in Chapter 55, means any animal:
A. Which has physically injured or killed another domestic animal,
livestock, or pen while off its owner’s or keeper’s property.
B. Which bites, inflicts injury, assaults or otherwise attacks a human being, domestic animal or livestock without provocation on any public or
private property; or
C. Which has been used primarily or in part of the purpose of fighting or trained for fighting.
57.02 KEEPING OF DANGEROUS ANIMALS PROHIBITED.
No person shall keep, shelter, or harbor any dangerous animal as a pet, or act as a temporary custodian for such animal, or keep, shelter or harbor such animal for any purpose or in any capacity within the City.
57.03 KEEPING OF VICIOUS ANIMALS PROHIBITED.
No person shall keep, shelter, or harbor for any reason within the City a vicious animal except in the following circumstances:

"Dangerous animal" means (a) any animal which is not naturally tame or gentle, and which is of a wild nature or disposition, and which is capable of killing, inflicting serious injury upon, or causing disease among human beings or domestic animals and having known tendencies as a species to do so; (b) any animals declared to be dangerous by the Madison County Board of Health or the City Council; and (c) the following animals which shall be deemed to be dangerous animals per se:
(15.) "Pit bull dog" shall mean:
(a) the Staffordshire bull terrier breed of dog;
(b) the American pit bull terrier breed of dog;
(c) the American Staffordshire terrier breed of dog;
(d) dogs of mixed breed or of other breeds than listed above which breed or mixed breed is known as pit bulls, pit bull dogs or pit bull terriers.
(e) any dog which has the appearance and characteristics of being predominantly of the breeds of Staffordshire bull terrier, American pit bull terrier, American Staffordshire terrier, any other breed commonly known as pit bulls, pit bull dogs or pit bull terriers or a combination of any of these breeds.
3.203 KEEPING OF DANGEROUS ANIMALS PROHIBITED
No person shall keep, shelter, or harbor any dangerous animal as a pet, or act as a custodian whether temporary or otherwise for such animal, or keep such animal for any other purpose or in any other capacity within the corporate limits of the City, except as may be provided by Section 3.204.
