Owners of Rottweilers and Pit Bull Terriers shall comply with the following requirements:

A. No owner shall permit a Rottweiler, or a Pit Bull Terrier, off of the owner's premises unless it is on a nonretractable leash no longer than six feet in length.

B. No owner shall permit a Rottweiler, or a Pit Bull Terrier, off of the owner's premises except when it is in the care and control of the owner, or a family member, sixteen years of age or older.

C. The owner of a Rottweiler, or a Pit Bull Terrier:
1.Within one year of obtaining a Village license thereon, shall be required to install a "special enclosure," or enclose the yard with a fence, and to keep the animal within the "special enclosure," or fence, at all times the animal is not within the owner's residence; or
2.Shall keep the animal on a nonretractable leash no longer than six feet in length and in the care and control of the owner, or a family member, sixteen years of age or older, at all times the animal is not within the owner's residence.
D. A fenced yard shall meet the following requirements:1.The fence shall be a minimum of five feet in height, and2.All gates shall be equipped with self-closing and self-latching mechanisms designed to securely close and lock the gate.
E. The owner of a Rottweiler, or a Pit Bull Terrier shall display Village-approved signage on all entrances to the property. Such sign shall state "Beware of Dog" and shall be displayed in a conspicuous manner.

(A) No person presently possessing a pit bull dog and/or vicious dog shall possess it after ten days of the effective date of this chapter without having first obtained a license therefor from the village.
(B) An application for a license to possess a pit bull dog and/or vicious dog shall be filed at Village Hall on a form entitled, “License To Possess A Pit Bull”, and shall be accompanied by all of the following:
(1) Verification of the identity of the owner and current address by providing a copy of the owner’s driver’s license or other approximate form of identification;
(2) Proof of ownership of the pit bull and/or vicious dog;
(3) A copy of the current immunization and health record of the pit bull and/or vicious dog prepared by a veterinarian licensed to practice in the state;
(4) A certificate of insurance evidencing coverage in an amount not less than $100,000 providing coverage for any injury, damage or loss caused by the pit bull and/or vicious dog;
(5) Two photographs of the pit bull dog to be licensed taken not less than one month before the date of the application. One photograph shall provide a front view of the pit bull and/or vicious dog and shall clearly show the face and ears of the pit bull and/or vicious dog. One photograph shall show a side view of the pit bull and/or vicious dog;
(6) A license fee of $100; and
(7) The village may require other information as is necessary.
(C) Upon receipt of an application, the village shall forward it to the Village Police Department, which shall cause an inspection of the premise on which the pit bull and/or vicious dog shall be kept to determine that the applicant has complied with all applicable provisions. Upon completion of the inspection, the Police Department shall notify the village, in writing, of the results of its inspection.
(D) Upon receipt of the results of the Police Department inspection, the village shall notify the applicant of the approval or denial of the license. In the event the license is denied, the notification shall be provided in writing and the reasons for the denial shall be stated. Upon approval, the village shall issue a license to the applicant.

Ownership of Pit Bulls, as such dogs are defined in this chapter, shall, in addition to any other requirements imposed by this chapter or state law, be subject to the following requirements:
 
   (A)   No owner shall permit a Pit Bull outside of its enclosure unless it is:
 
      (1)   Securely muzzled;
 
      (2)   On a nonretractable leash or chain with a tensile strength of 300 pounds and not exceeding 3 feet in length; and
 
      (3)   Is under the direct control and supervision of the owner, or a family member, 16 years of age or older.
 
   (B)   The owner of a Pit Bull shall display Village-approved signage on all entrances to the property. Such sign shall state "Beware of Dog", "Pit Bull Dog", or "Dangerous Dog" and shall be displayed in a conspicuous manner. Such sign shall have lettering that is clearly legible and at least 2 inches in height, and shall be posted in a conspicuous location on the fence enclosing the yard of the residence or gate thereto, or, where a Pit Bull is also kept within the residence, at any entrance doors to the building or residence where the Pit Bull resides.
 
   (C)   Prior to obtaining a Village permit for a Pit Bull, an owner shall be required to install an exterior enclosure, as defined in this chapter, and to keep the Pit Bull within the enclosure at all times the animal is on the owner's property but not within the owner's residence.
 
   (D)   All gates on fences at residences and enclosures where a Pit Bull is kept or resides shall be equipped with self-closing and self-latching mechanisms designed to securely close and lock the gate.
 
   (E)   No Village permit shall be issued for ownership of a Pit Bull over 4 months of age without proof that the Pit Bull has been spayed or neutered.
 
   (F)   In addition to permitting requirements set forth elsewhere in this chapter, no Village permit shall be issued for ownership of a Pit Bull without the submission of proof by the owner that:
 
      (1)   The Pit Bull has received obedience training from a certified, licensed trainer in the past calendar year and has passed the obedience test related to said training; and
 
      (2)   The owner has a current homeowners or renter's insurance policy covering the address where the Pit Bull is kept or resides.
 
   (G)   No Village permit shall be issued for ownership of a Pit Bull to a tenant without a signed consent from the landlord indicating that the Pit Bull is allowed to reside on the premises. The tenant shall have to comply with the enclosure provision and each of the other provisions set forth in this chapter.
 
   (H)   No Village permit shall be issued for ownership of a Pit Bull for a residence that is within 1,500 feet of a school, public park, playground, day care facility, or other similar facility. This division shall not apply to Pit Bulls who resided at such a residence prior to the effective date of this amendatory ordinance of 2006 and for whom valid Village permits evidencing such residency had previously been obtained.

Licensing And Insurance:

1.a. Pit Bull Kennel License: No person shall own, keep or harbor any pit bull over six (6) months of age in any household, residence, or any property whatsoever within the city of North Chicago without first obtaining a pit bull kennel license from the city of North Chicago.

b. Information Reported To The City: All owners, keepers, or harborers of registered pit bulls must report the following information in writing to the city:
(1)The removal from the city or death of a registered pit bull.
(2)The birth of offspring of a registered pit bull.
(3)The new address of a registered pit bull owner should the owner move within the city limits.

c. Applications: Applications for a pit bull kennel license shall be filed with the city of North Chicago and shall provide the following information:
(1)Name of applicant.
(2)Name of owner of the pit bull if different from applicant.
(3)Address where pit bull will be kept.
(4)Number of pit bulls to be kept on premises.
(5)Method to be used to secure or restrain the animals.
(6)Name of person or persons responsible for care and confinement.
(7)Any other information requested by the city.
All applications shall be accompanied by a nonrefundable fifty dollar ($50.00) application fee.

DANGEROUS DOG: Any dog with a known propensity, tendency or disposition to attack unprovoked, to cause injury to, or to otherwise endanger the safety of humans or other domestic animals; or

Any dog which attacks a human being or other domestic animal without provocation; or

Any dog which is a "pit bull terrier", which shall herein be defined as any American pit bull terrier or Staffordshire bull terrier or American Staffordshire terrier breed of dog or any mixed breed of dog which contains as an element of its breeding the breed of American pit bull terrier, Staffordshire bull terrier or American Staffordshire terrier as to be identifiable as partially of the breed of American pit bull terrier, Staffordshire bull terrier or American Staffordshire terrier.
